R v C

The applicant sought the removal of the sole arbitrator in a pending IAC arbitration, alleging concerns regarding the arbitrator’s independence, impartiality, disclosure obligations, nationality, and fee arrangements. The AIFC Court rejected all grounds of challenge, holding that the arbitrator’s professional contacts with counsel, nationality, and fee arrangements did not give rise to objectively justifiable doubts as to his independence or impartiality.
