PRIVATE COMPANY “DOCUMENTOLOG GLOBAL LIMITED” v LIMITED LIABILITY PARTNERSHIP “BEREKE LLP”

Documentolog Global Limited brought a claim against Bereke LLP for unpaid fees under an agreement for the provision of an electronic document management system. Although the Defendant accepted the service certificates issued by the Claimant, it failed to pay the amounts due under the contract. The AIFC Small Claims Court found that the debt was proven and unchallenged, awarded the outstanding service fees together with a contractual late-payment penalty, and additionally ordered the Defendant to reimburse the Claimant’s document translation costs because its failure to engage with the dispute made the proceedings necessary.
